Asbestos Management for Commercial Properties

Are you the landlord, tenant or managing agent of a commercial property unless otherwise stated you may be responsible for managing asbestos.

What you must do

  1. Check your lease or contract as this will state who is responsible for asbestos.
  2. Get a professional asbestos survey conducted to find out where the asbestos is on your property.
  3. Have the asbestos analysed and keep a record of what you find.
  4. Ensure your Asbestos register is updated and be sure to share the information with anyone likely to come into contact with asbestos, e.g. builders.
  5. Check on any ACMs as defined in the asbestos report to ensure they are kept in good repair

Owners of derelict or vacant premises and warehouses also need an asbestos survey.

Without a plan in place to deal with asbestos, you could face:

  • a fine of up to £20,000
  • imprisonment for up to 6 months

For serious cases an unlimited fine and/or imprisonment of up to 2 years can be handed down.
