Asbestos Law for Business – Legal Compliance
Do your premises comply with UK asbestos regulations?
If you’re a business owner or you manage non-domestic premises, such as a shop, you are responsible for protecting those who work or use those premises from the risks of ill health caused by asbestos exposure.
You must ensure the premises comply with UK asbestos regulations; Control of Asbestos 2012, Regulation 4 – Duty to Manage.
If there’s a possibility that customers, employees or contractors could come into contact with asbestos, you must have an asbestos management plan.
The plan should outline who has the “duty” and responsibility. It must be easy to read, easy to find and easy to update.
Here’s what your plan for asbestos management should include:
Don’t bury your head in the sand
Poor asbestos management can have potential health consequences. In addition, failing to deal with asbestos on your business premises now could result in problems down the line.
For example, if when you sell your business it’s discovered that the building is non-compliant, it can hold up the sale. Asbestos surveyors may need to be called in at the last minute, jeopardising the transaction.
If you don’t have a plan for asbestos management, or you have one but don’t action it, there are serious implications.
These include a fine of up to £20,000, imprisonment for up to six months, an unlimited fine and/or imprisonment of up to two years for serious circumstances.
